1. Agreement to Terms

By accessing or using My Magic Moments ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service. You must be at least 18 years old or have parental/guardian consent to use this Service.

2. Service Description

My Magic Moments provides a platform for creating personalised, AI-generated children's storybooks and colouring-in books. Users can customise stories by providing photos, names, ages, and interests to create unique printed books where their child becomes the main character of the story.

3. User Accounts

To access certain features of the Service, you may need to create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorised use of your account

4. Orders and Payments

All orders are subject to acceptance and availability. Prices are listed in South African Rand (ZAR) and include applicable taxes. Payment is processed securely through PayFast (supporting card payments, Instant EFT, Apple Pay and Google Pay). By placing an order, you authorise us to charge your payment method for the total amount. We reserve the right to refuse or cancel any order for any reason, including availability, errors in product information, or suspected fraudulent activity.

5. User Content and Photo Uploads

When you upload photos and provide personalisation information, you represent and warrant that:

  • You own or have the right to use the photos and information you provide
  • You have obtained consent from parents/guardians to use photos of children
  • The content does not violate any third-party rights or applicable laws
  • The content is not offensive, defamatory, or inappropriate

By uploading content, you grant My Magic Moments a license to use, process, and reproduce the content solely for the purpose of creating and delivering your personalised book. We do not use your photos for any other purpose without your explicit consent.

6. Intellectual Property

All AI-generated stories, illustrations, and book designs created through the Service are the intellectual property of My Magic Moments. Upon purchase, you receive a personal, non-transferable, non-exclusive license to use the printed book for personal, non-commercial purposes only.

You may not reproduce, distribute, modify, create derivative works, publicly display, or otherwise exploit the generated content for commercial purposes without our prior written consent.

7. Prohibited Uses

You agree not to use the Service to:

  • Upload inappropriate, offensive, or unlawful content
  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Transmit malicious code or attempt to disrupt the Service
  • Reverse engineer or attempt to extract source code
  • Use the Service for commercial purposes without authorisation

8. Shipping and Delivery

We aim to process and ship orders within the timeframe specified at checkout. Delivery is available nationwide across South Africa. Risk of loss and title pass to you upon delivery to the carrier. We are not responsible for delays caused by shipping carriers or circumstances beyond our control.

9. Digital Preview, Changes, and Refunds

After purchase, you will receive a digital preview of your personalised book. You have 24 hours to review your book and either approve it or request changes.

  • One-time change request: If something isn't quite right, you may request changes once. Change requests cover quality issues with how the book was produced — for example, illustration corrections, text errors, or content that doesn't reflect the details you provided.
  • What change requests do not cover: Changes to your original personalisation choices — such as swapping a supporting character, uploading a different photo, changing the adventure theme, illustration style, story language, or the child's name, age, or gender — are not covered. These choices shape the entire book and altering them requires generating a new book from scratch.
  • Full refund guarantee: If you are still not satisfied after the revision, you may request a full refund — no questions asked. The refund guarantee applies during the review process only, before the book enters production.
  • Automatic approval: If no action is taken within the 24-hour review period, your book will be automatically approved and sent to print.

Due to the personalised nature of our products, we do not accept returns for change of mind after the book has been printed. However, if your book arrives damaged or with printing errors not caused by user-provided content, please contact us within 14 days of delivery. We will assess the issue and, at our discretion, offer a replacement.

10. Limitation of Liability

To the fullest extent permitted by law, My Magic Moments shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

11. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

12. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to the Service. Your continued use of the Service after changes are posted constitutes your acceptance of the modified terms.

13. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of South Africa.
